1. Acceptance of Terms

By accessing or using the IHA AI Academy platform (the "Platform"), operated by the Institute for Human Advancement ("IHA," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform.

2. Eligibility

You must be at least 13 years of age to use the Platform. If you are between 13 and 18 years of age, you must have the consent of a parent or legal guardian. By using the Platform, you represent that you meet these eligibility requirements.

3. Account Registration

To access certain features of the Platform, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information.
• Keep your password secure and confidential.
• Accept responsibility for all activities that occur under your account.
• Notify us immediately of any unauthorized use of your account.

4. Purchases and Payments

4.1 Free and Paid Programs

The Platform offers free learning experiences, one-time paid course purchases, and separately scoped cohort or organization programs. The current price, included access, delivery format, and assessment requirements are shown before you enroll or pay.

4.2 Billing

Self-serve certification purchases displayed as one-time payments are charged once through our payment processor, Stripe, and do not automatically renew. You authorize us to charge the price and currency shown at checkout. Cohort, organization, grant, or partner programs may have separate written terms that are disclosed before commitment.

4.3 Course Access

A one-time course purchase provides the access described on its offer page, subject to these Terms, the continued operation of the Platform, any refund, and any suspension or revocation required for misuse. It is not a recurring subscription that needs to be cancelled.

4.4 Refunds

We offer a 14-day, no-questions-asked money-back guarantee. You may request a full refund within 14 days of any paid purchase, for any reason. Contact us at support@humanadvancementinstitute.org and we will process your refund.

5. Course Content and Certificates

5.1 Educational Content

All course content, including videos, text, quizzes, and interactive materials, is provided for educational purposes. We strive for accuracy but do not guarantee that all content is error-free or current. AI and technology evolve rapidly, and some information may become outdated.

5.2 Certificates

Certificates of completion are issued upon meeting course requirements (including passing quizzes with a minimum score). Certificates are issued by IHA AI Academy and represent completion of our curriculum. They are not accredited academic degrees or professional certifications.

6. Sage Learning and AI-Powered Features

The Platform includes AI-powered features, including an AI mentor (Sage Learning). You understand and agree that:

• AI-generated responses are for educational guidance only and should not be relied upon as professional advice.
• AI responses may occasionally contain errors or inaccuracies.
• Your interactions with AI features may be processed by third-party AI providers (Anthropic, OpenAI) under their data processing agreements.
• A limited sample of interactions may be reviewed for quality and safety and is subject to the retention and learner-control terms in our Privacy Policy.
• AI usage may be subject to daily or monthly limits based on your subscription tier.

7. Community Guidelines

When using our forums, discussion boards, and community features, you agree to:

• Treat all community members with respect and professionalism.
• Not post content that is abusive, harassing, discriminatory, defamatory, or threatening.
• Not share spam, advertisements, or promotional content without authorization.
• Not share course content, quiz answers, or copyrighted materials.
• Not impersonate other users or misrepresent your identity.
• Not attempt to manipulate or disrupt the Platform or its users.

We reserve the right to remove content and suspend or terminate accounts that violate these guidelines at our sole discretion.

8. Intellectual Property

8.1 Our Content

All content on the Platform, including courses, text, graphics, logos, and software, is the property of IHA or its licensors and is protected by copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

8.2 Your Content

You retain ownership of content you create and post on the Platform (forum posts, project submissions, etc.). By posting content, you grant IHA a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with the Platform.

9. Limitation of Liability

To the fullest extent permitted by law, IHA shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Platform.

10. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Termination

We may terminate or suspend your account and access to the Platform at any time, with or without cause, with or without notice. Upon termination, your right to use the Platform will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of New York County, New York.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Platform and updating the "Last updated" date. Your continued use of the Platform after changes constitutes acceptance of the modified Terms.
